Welcome to Qausainflix.

These Terms & Conditions (“Terms”) govern your access to and use of the Qausainflix website, applications, streaming platform, digital content, subscription services, and related products and services.

Qausainflix is operated by Qausain Group Ltd. (“Qausain Group”, “Qausainflix”, “we”, “us”, or “our”).

By accessing, registering for, subscribing to, or using Qausainflix, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use Qausainflix.

1. About Qausainflix

Qausainflix is a digital entertainment and streaming platform that may provide access to movies, television programmes, series, documentaries, educational content, children's content, live programming, and other audio-visual or digital content.

Content and features available through Qausainflix may vary depending on location, subscription plan, device, licensing arrangements, and other factors.

We reserve the right to add, remove, modify, suspend, or discontinue content or features at any time, subject to applicable law and any contractual obligations owed to subscribers.

2. Eligibility

You may use Qausainflix only if you are legally capable of entering into a binding agreement under applicable law.

If you are below the applicable age of contractual capacity, you should use Qausainflix only with the involvement and permission of a parent or legal guardian where required.

By creating an account, you confirm that the information you provide is accurate and that you have the legal capacity or appropriate authorisation to accept these Terms.

3. Creating a Qausainflix Account

Certain features may require you to create an account.

When registering, you agree to:

  • Provide accurate and current information;

  • Keep your account information updated;

  • Maintain the confidentiality of your login credentials;

  • Take reasonable steps to prevent unauthorised access to your account;

  • Notify us promptly if you suspect unauthorised access.

You are responsible for activity occurring through your account unless the activity resulted from circumstances for which you are not legally responsible.

We may suspend or restrict an account where we reasonably believe that it has been compromised, misused, or used in violation of these Terms.

4. Account Sharing

Unless expressly permitted by a Qausainflix subscription plan, promotional offer, or other written terms, you must not share your account credentials with persons outside the permitted users associated with your account.

You must not sell, rent, sublicense, transfer, or commercially exploit your Qausainflix account.

Qausainflix may implement reasonable technical measures to detect and prevent unauthorised account sharing or access.

5. Subscriptions

Some Qausainflix content and features may require a paid subscription.

Subscription plans may differ in:

  • Price;

  • Duration;

  • Available content;

  • Streaming quality;

  • Number of supported devices;

  • Number of simultaneous streams;

  • Features;

  • Availability by country or region.

The specific terms displayed when you subscribe form part of your agreement with Qausainflix.

We reserve the right to introduce, modify, or discontinue subscription plans, subject to applicable law and any rights you may have under an existing paid subscription.

6. Subscription Fees

Subscription prices will be displayed before you complete a purchase.

Unless otherwise stated:

  • Prices are payable in the currency displayed at checkout;

  • Applicable taxes or charges may be added where required;

  • Your subscription becomes active after successful payment confirmation;

  • Your access may be restricted if payment is unsuccessful or reversed.

Qausainflix may use authorised third-party payment processors to process payments.

7. Automatic Renewal

Where a subscription is described as automatically renewing, the subscription may renew at the end of each billing period unless you cancel it before the renewal date.

The applicable renewal price will be the price communicated to you at the time of renewal, subject to applicable law.

If you do not want your subscription to renew automatically, you must cancel it through the available account or subscription-management mechanism before the renewal date.

Where automatic renewal is not offered, your subscription will expire at the end of the applicable subscription period unless you purchase a new subscription.

8. Cancellation

You may cancel your subscription according to the cancellation options made available through Qausainflix or the relevant payment provider.

Cancellation generally prevents future renewal but does not necessarily provide a refund for the unused portion of an already-paid subscription period, except where:

  • A refund is required by applicable law;

  • Qausainflix expressly offers a refund;

  • A specific promotional or subscription offer provides otherwise; or

  • A refund is approved by Qausainflix in accordance with its applicable refund policy.

9. Refunds

Unless otherwise required by applicable law, subscription payments are generally non-refundable once a subscription period has commenced.

However, Qausainflix may provide refunds or credits in appropriate circumstances, including certain:

  • Duplicate payments;

  • Technical failures;

  • Billing errors;

  • Unauthorised transactions;

  • Service-related issues; or

  • Other circumstances determined by Qausainflix.

Where a payment was processed by a third-party payment provider, additional terms of that provider may apply.

10. Free Trials and Promotional Offers

Qausainflix may occasionally provide free trials, promotional subscriptions, discounts, promotional codes, or other special offers.

Promotional offers:

  • May be subject to additional terms;

  • May be limited to eligible users;

  • May be used only once unless expressly stated otherwise;

  • May be withdrawn or modified where permitted by law.

We may require valid payment information for certain trial offers.

If a trial automatically converts into a paid subscription, the applicable conversion terms and renewal information will be presented before or during registration.

11. Content Availability

Qausainflix does not guarantee that any particular movie, programme, series, channel, or other content will remain available indefinitely.

Content may be affected by:

  • Licensing arrangements;

  • Geographic restrictions;

  • Copyright restrictions;

  • Distribution agreements;

  • Technical requirements;

  • Regulatory requirements;

  • Changes requested by content owners.

Content may therefore be added, removed, replaced, or temporarily unavailable.

12. Geographic Restrictions

Certain content may only be available in particular countries or territories.

Qausainflix may use reasonable technical measures to determine a user's general geographic location and enforce applicable content licensing restrictions.

Attempting to bypass geographic restrictions or other access controls may constitute a violation of these Terms.

13. Streaming and Compatible Devices

Qausainflix may support various devices, including:

  • Smartphones;

  • Tablets;

  • Computers;

  • Smart TVs;

  • Streaming devices; and

  • Other compatible devices.

Supported devices and operating systems may change over time.

Qausainflix does not guarantee compatibility with every device, browser, operating system, internet connection, or network configuration.

Streaming quality may depend on:

  • Internet speed;

  • Network congestion;

  • Device capabilities;

  • Location;

  • Content format;

  • Qausainflix infrastructure; and

  • Other technical conditions.

14. Internet Connection

You are responsible for obtaining and maintaining the internet connection and compatible equipment required to access Qausainflix.

Your internet service provider or mobile network provider may charge you separately for data usage.

Qausainflix is not responsible for charges imposed by your internet or telecommunications provider.

15. Permitted Use

Subject to these Terms and your applicable subscription, Qausainflix grants you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the service for personal, non-commercial entertainment purposes.

You must not:

  • Copy Qausainflix content without permission;

  • Record or capture protected streams;

  • Download content except through an officially provided download feature;

  • Redistribute Qausainflix content;

  • Publicly display subscription content without permission;

  • Sell or commercially exploit access to Qausainflix;

  • Rent or sublicense Qausainflix content;

  • Circumvent digital rights management or technical protection measures;

  • Attempt to reverse engineer the platform;

  • Interfere with Qausainflix servers or infrastructure;

  • Introduce malware or other harmful code;

  • Use automated systems to scrape or extract platform data without permission;

  • Attempt to gain unauthorised access to accounts or systems;

  • Use Qausainflix for unlawful purposes.

16. Intellectual Property

All rights, title, and interest in Qausainflix's platform, software, website, branding, logos, designs, interfaces, text, graphics, and other proprietary materials belong to Qausain Group Ltd. or its licensors, unless otherwise stated.

Qausainflix content may be owned by Qausain Group Ltd., content creators, production companies, broadcasters, distributors, licensors, or other rights holders.

Nothing in these Terms transfers ownership of intellectual property to you.

You may not reproduce, distribute, modify, publicly perform, publicly display, sell, license, or otherwise exploit protected Qausainflix materials without the appropriate permission.

17. User-Generated Content

Where Qausainflix allows users to submit comments, reviews, ratings, profiles, images, messages, or other material (“User Content”), you remain responsible for the material you submit.

You must not submit material that:

  • Is unlawful;

  • Infringes another person's intellectual property;

  • Contains malicious code;

  • Is fraudulent or misleading;

  • Harasses or threatens others;

  • Contains unlawful hate or discriminatory content;

  • Violates another person's privacy;

  • Is sexually explicit where prohibited;

  • Exploits or endangers children;

  • Violates applicable law.

By submitting User Content, you grant Qausainflix a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and use that content as reasonably necessary to operate and improve the relevant Qausainflix features, subject to applicable law.

We may remove User Content that violates these Terms or applicable law.

18. Third-Party Services and Links

Qausainflix may contain links to or integrations with third-party websites, applications, payment providers, advertising services, or other services.

Third-party services are not necessarily controlled by Qausainflix.

Your use of third-party services may be subject to their own terms and privacy policies.

Qausainflix is not responsible for the content, policies, security, availability, or practices of third-party services except to the extent required by applicable law.

19. Advertising and Promotions

Qausainflix may display advertisements, sponsorships, promotional messages, or other commercial content where applicable.

Advertisers or third-party partners may have their own terms and privacy policies.

We do not guarantee the accuracy, quality, legality, or availability of third-party products or services advertised through the platform.

20. Service Availability

We aim to provide reliable access to Qausainflix, but we do not guarantee that the service will always be:

  • Available;

  • Uninterrupted;

  • Error-free;

  • Secure;

  • Free from technical problems; or

  • Available on every device.

The service may occasionally be unavailable because of:

  • Maintenance;

  • Upgrades;

  • Technical failures;

  • Network problems;

  • Cybersecurity incidents;

  • Power or infrastructure failures;

  • Third-party service failures;

  • Events beyond our reasonable control.

We will take reasonable steps to restore service when interruptions occur.

21. Account Suspension and Termination

Qausainflix may suspend or terminate your account where permitted by law if:

  • You materially breach these Terms;

  • You engage in fraudulent activity;

  • You attempt to circumvent security controls;

  • You misuse the service;

  • Your account is used for unlawful activity;

  • Your payment is fraudulent, reversed, or otherwise invalid;

  • Your conduct creates a security or legal risk.

Where appropriate and legally required, we may provide notice before suspension or termination.

Termination does not eliminate obligations or liabilities that arose before termination.

22. Privacy

Your use of Qausainflix is also governed by our Privacy Policy.

Our Privacy Policy explains how we collect, use, store, protect, and disclose personal information.

23. Disclaimer

To the maximum extent permitted by applicable law, Qausainflix is provided on an “as available” basis.

We do not guarantee that the service will meet every user's expectations or that every item of content will always be available.

Nothing in these Terms excludes or limits any consumer right, statutory protection, or liability that cannot lawfully be excluded or limited.

24. Limitation of Liability

To the maximum extent permitted by applicable law, Qausain Group Ltd. and its directors, officers, employees, affiliates, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of Qausainflix.

This may include losses resulting from:

  • Loss of data;

  • Loss of profits;

  • Loss of business;

  • Loss of opportunity;

  • Service interruption;

  • Device or network problems; or

  • Unauthorised access,

except where such liability cannot lawfully be excluded or limited.

Nothing in these Terms excludes liability for matters that cannot legally be excluded under applicable law.

25. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, damages, and reasonable expenses arising from your unlawful use of Qausainflix or your material violation of these Terms.

This provision does not apply to the extent that the relevant loss was caused by Qausain Group Ltd.'s own unlawful conduct or liability that cannot legally be transferred to you.

26. Changes to the Service

We may modify, update, suspend, or discontinue parts of Qausainflix from time to time.

Where a change materially affects an existing paid subscription, we will take reasonable steps to provide notice where required by applicable law.

27. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may notify users through Qausainflix, email, or another appropriate method.

The updated Terms will become effective on the date stated at the beginning of the revised Terms.

Your continued use of Qausainflix after the effective date of updated Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

28. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria, subject to any mandatory rights or protections that apply to you under applicable law.

Where a dispute arises, the parties should first attempt to resolve the matter amicably.

Nothing in this section prevents a party from seeking urgent legal relief where appropriate.

29. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable where legally possible.

The remaining provisions will continue in full force and effect.

30. No Waiver

Failure by Qausainflix to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

31. Entire Agreement

These Terms, together with the Qausainflix Privacy Policy and any additional terms expressly applicable to specific services or promotions, constitute the agreement between you and Qausainflix regarding your use of the service.

33. Acceptance
